DESCRIPTION

 SPECIFIC RULES

 

The Contest

 

1.      The Brain Games Instagram Photo Contest (“Contest”) is an Instagram photo contest organised by Star Regional (SEA) Pte Ltd’s (“FIC Singapore”) for National Geographic Channel Singapore (“NGC Singapore”).

 

2.      The Contest will run from midnight (Singapore time) on 1 October 2013 to 23:59 (Singapore time) on 27 October 2013.

 

3.      The Contest is subject to these Specific Rules and FIC Singapore’s general terms and conditions for contests which may be found at natgeotv.com/asia/BrainGamesSG.

 

How to Participate in the Contest

4.      During the period of the Contest, you have to follow NGC Singapore’s official Instagram account @NGC_Singapore and (b) upload a photo or video that best represents the theme “Perspective”   (“Submission”).

 

5.      To enter the Contest, you need to have an Instagram account to follow NGC Singapore on Instagram.

 

6.      Each Submission must be labeled with the hashtag: #BrainGamesSG. Failure to include the hashtag will result in the automatic disqualification of the Submission.

 

7.      Each Submission must be entrant’s original creation and he/she must havethe appropriate rights under intellectual property laws.

 

8.      Each day during the Contest, the entrant who posts the Submission judged to be the most creative and that best represents the theme “Perspective” will be selected as the daily winner of the Contest for that day and shall win a Daily Prize (as defined below). FIC Singapore has the right to, and shall select, the winning Submission for each day of the Contest at its sole and absolute discretion.

 

9.      At the end of each week of the Contest, the entrant who posts any of the top three (3) Submissions that receives the most Instagram "likes" during that week of the Contest will be selected as the weekly winner of the Contest and shall win a Weekly Prize (as defined below).

 

10.    You may submit as many entries as you like but please note that you will only be entitled to win one (1) Daily Prize for each day of the Contest and if applicable, one (1) Weekly Prize for each week of the Contest, regardless of the number of entries you submit during the period of the Contest.

 

11.     FIC Singapore has the right to reject what, in its sole discretion, it considers to be inappropriate or corrupted entries. The decision of FIC Singapore as to whether an entry is inappropriate or corrupted is final.

 

 

Content Guidelines

 

12.    Submissions may not contain, as determined by FIC Singapore, in its sole discretion, any content that:

 

·         is sexually explicit or suggestive;

·         unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group;

·         promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);

·         appears to duplicate any other Submission;

·         contains any personal identification, such as license plate numbers, e-mail addresses or street addresses;

·         contains copyrighted materials owned by others or any trademarks, names or logos owned by others;

·         communicates messages inconsistent with the positive images and/or goodwill to which NGC Singapore and FIC Singapore wish to associate;

·         and/or violates any law.

 

Qualifying Entrants

13.    To qualify to enter the Contest, you must be a Singapore citizen or legal resident of Singapore.

 

14.    The Contest is only open to entrants of 18 years of age and over on the date of entry.

 

15.    All entries for each day of the Contest must be posted on Instagram with the hashtag #BrainGamesSG no later than 23.59 (Singapore time) on that day to be considered as a winner of the Contest for that day.

 

16.    Any Submission posted on Instagram prior to the commencement of the Contest must be re-posted with the hashtag #BrainGamesSG during the period the Contest is running to be considered an eligible Submission. Only the Instagram "likes" received by the Submission during the period of the Contest will be taken into account to determine the winners of the Weekly Prizes.

 

Prizes

 

17.    The daily prize winner of each day of the Contest to be selected at the sole and absolute discretion of FIC Singapore will receive a prize consisting of a NGC Tumbler, Monopack, Brain Stress Ball and one (1) issue of the National Geographic Magazine (“DailyPrize”). An entrant who has submitted any of the top 3 Submissions that receive the most Instagram "likes" for each week of the Contest will win a weekly Prize consisting of a NGC Brainworks Book, NGC Tumbler, Monopack, Brain Stress Ball and one (1) issue of the National Geographic Magazine (“Weekly Prize”).

 

18.    The Daily Prize winners will be announced on the official Instagram account of NGC Singapore at 10 a.m. on the day following each day of the Contest. The Weekly Prize winners for each week of the Contest will be announced on October 7, 14, 21 and 28, 2013 respectively. NGC Singapore will announce all winners by re-posting the winning Submissions on NGC Singapore’s Instagram account. Each prize winner must contact NGC Singapore at NGCSingapore@fox.com within one month of being announced as the winner. All Daily Prizes and Weekly Prizes will be sent to the winners by post.

 

19.    The prizes are provided by FIC Singapore, and it is solely responsible for fulfillment of all the prizes.

 

GENERAL TERMS & CONDITIONS

General

1.      These rules are the general terms and conditions ("Terms and Conditions") that apply to the Brain Games Instagram Photo Contest ("Contest") described at the URL address natgeotv.com/asia/BrainGamesSG ("Site"), unless otherwise expressly stated. By entering the Contest, entrants agree to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions, please do not enter the Contest.

 

2.      Specific rules relating to the Contest are displayed on the Site ("Specific Rules") and are incorporated herein. In the event of discrepancy between these Terms and Conditions and the Specific Rules, the Specific Rules shall prevail. If you do not accept the Specific Rules, please do not enter the Contest.

 

3.      FIC Singapore reserves the right to cancel or modify the Contest, and amend the Specific Rules and/or these Terms and Conditions at any time without prior notice. Any changes will be posted either within the Specific Rules or these Terms and Conditions, as the case may be. If you do not accept any changes to the Specific Rules and/or these Terms and Conditions, please do not continue to participate in the Contest.

 

4.      In the event of any dispute regarding the Terms and Conditions, Specific Rules, conduct of the Contest, results and any other matter relating to the Contest, the decision of FIC Singapore and shall be final and no correspondence or discussion shall be entered into.

Qualifying Entrants

5.      The Contest is open to residents of the territories as stated in the Specific Rules. When requested by FIC Singapore and for the purposes of administering the Contest, each entrant must provide his/her full name, the first four digits of his/her passport or identity card number, a valid telephone contact number and a contact email address. The Contest is only open to entrants of 18 years of age and over.

 

6.      Employees and agents of any sponsor or promoter of the Contest, NGC Network Asia, LLC, ESPN STAR Sports, STAR TV, FIC Singapore, Fox International Channels or any advertising agency or web company connected with any of these companies ("Specified Companies") or any subsidiary or associated company of the Specified Companies, as well as members of their families or households, may enter the Contest but are not eligible to win any of the Daily Prizes. FIC Singapore reserves the right to verify the eligibility of all entrants.

 

7.      FIC Singapore will assume (and by entering the Contest each entrant warrants) that either he/she has legal capacity to enter into the agreement set out in the Specific Rules and these Terms and Conditions (i.e., that he/she is of sufficient age and mental capacity and are otherwise entitled to be legally bound in contract).

 

8.      By entering the Contest, each entrant:

(a)    warrants that he/she has read and understood these Terms and Conditions and the Specific Rules and agree to be bound by them;

(b)   warrants that he/she has read and understood the terms and conditions of Instagram and agree to be bound by them;

(c)    warrants that all information submitted by him/her is true, accurate, current and complete; and

(d)   warrants that his/her entry does not defame, cause injury or invade the privacy of or otherwise infringe or violate any applicable law, regulation, custom, intellectual property rights or any other rights of any third party.

9.      FIC Singapore reserves the right to disqualify or exclude any entrant from the Contest and withhold prizes if it has reasonable grounds to believe the entrant has breached any of these Terms and Conditions and/or the Specific Rules.

 

10.    In the event that any entrant is disqualified from the Contest, FIC Singapore may at its sole and absolute discretion decide whether to select another winner from entries received before the specified closing date. Any alternate winner will be selected on the same criteria as the original entrant and will be subject to the Specific Rules and these Terms and Conditions.

 

11.    Eligibility and entitlement to prizes may change for regulatory reasons in which case the Terms and Conditions and/or the Specific Rules shall be amended accordingly. Each entrant agrees that FIC Singapore shall not be held liable in the event that any persons are subsequently excluded from the Contest as a result of any regulatory direction or applicable law.

Contest Entries

12.    Contest entries must be made in the manner and by the closing date (if any) specified in the Specific Rules. Failure to do so will disqualify the entry.

 

13.    FIC Singapore does not accept responsibility or liability for any failure by any entrant to submit entries whether caused (a) by any error, omission, interruption, deletion, defect, delay or failure in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, server functions, virus, bugs or (b) inaccessibility or unavailability of the Internet or Instagram or any website or any combination thereof or (c) any other causes.

 

14.    FIC Singapore may, under appropriate circumstances, and at its sole discretion, request that Instagram removes or disables access to entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory etc. or for any other reason.

Prizes

15.    Winners will be selected from the entries that meet the requirements set out in the Specific Rules and these Terms and Conditions, and that were submitted by qualifying entrants and received by FIC Singapore before the specified date.

 

16.    Details of the Contest prizes and the basis of their award are set out in the Specific Rules. In all matters, the decision of FIC Singapore shall be final and binding. No correspondence or discussion shall be entered into.

 

17.    If more than one prize of the same type is awarded only one prize per entrant will be awarded.

 

18.    Claims for prizes must be made in the manner and within the time specified in the Specific Rules and/or prize notification. Return of any prize notification as undeliverable or failure to claim a prize within the time or in the manner specified may result in disqualification and selection of an alternate.

 

19.    Enquiries regarding prizes must be made via e-mail to NGCSingapore@fox.com. Should a winner not receive his/her prize within 90 days after being announced as the winner, he/she should contact FIC Singapore directly by sending an email to NGCSingapore@fox.com.

 

20.    Prizes are non-transferable and there is no cash alternative. FIC Singapore reserves the right to substitute prizes which may or may not be of equal value at any time.

 

21.    FIC Singapore reserves the right to request for (i) documentary proof of residency and/or age of any winner; (ii) documentary proof of prize/winner notification; (iii) the original copy of the entry that was submitted and/or (iv) an execution of release of liability and acknowledgement forms (in form and substance satisfactory to FIC Singapore), before any prize is dispatched.

 

22.    In the event that the prize or receipt thereof incurs any tax liability or other expenses, such tax or expenses shall be borne by and is the sole responsibility of the prize winner.

 

23.    Prizes are awarded on an "as is" basis without warranty of any kind from FIC Singapore, express or implied, save where this would be contrary to applicable law. Actual prizes awarded by FIC Singapore, and any of its sponsors, may differ from those shown anywhere in or during the Contest. Entrants shall not make any claims or demands in this regard. FIC Singapore will not be liable in the event that any and all prize(s) or part of any prize is not delivered or fulfilled.

Liability

24.    To the maximum extent permitted by applicable law, FIC Singapore and NGC Network Asia, LLC shall not be liable for any damage, loss, injury or disappointment suffered by any entrant entering the Contest or as a result of inability to participate in the Contest, or the acceptance or use of any prize. FIC Singapore and NGC Network Asia, LLC are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone or any device in relation to or resulting from participation or downloading of any materials in the Contest.

 

25.    By entering the Contest, each entrant agrees that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against the Specified Companies, their parent companies, affiliates, directors, officers, employees or agents for any and all losses, damages, rights, claims and actions of any kind resulting from entry into the Contest, inability to participate in the Contest, or acceptance or use of any prize.

Indemnity

26.    To the maximum extent permitted by applicable law, each entrant agrees to indemnify and keep indemnified FIC Singapore and NGC Network Asia, LLC, their officers, directors, employees, agents, distributors and affiliates from and against any and all claims, loss, damage or liability suffered and fees and costs incurred, including reasonable legal fees, resulting from any act, neglect or default or breach by him/her or any person who may be authorized by him/her or for whom he/she is responsible, of any of these Terms and Conditions and/or the Specific Rules.

Data Protection and Publicity

27.    Winners may be requested to take part in promotional activity. By entering the Contest, entrants agree that should they win the Contest, FIC Singapore and NGC Network Asia, LLC, may use, at no cost and without further notice, their names and addresses, and photographs, audio and/or visual recordings of them in any publicity or promotional material in any media.

 

28.    Any personal data relating to entrants will not be disclosed to a third party without the individual’s consent. FIC Singapore will take such steps as are reasonably practical to protect the data from any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction. Data relating to entrants will be retained by FIC Singapore for a reasonable period after the Contest closes to assist FIC Singapore to operate contests in a consistent manner and to deal with any queries on the Contest.

 

29.    FIC Singapore is not responsible or liable for the collection, use and disclosure by Instagram of any content or personal data relating to entrants posted on or collected through Instagram. Entrants are encouraged to carefully review Instagram’s privacy policies.

Intellectual Property

30.    In consideration of FIC Singapore agreeing to consider entrants to the Contest, each entrant hereby grants to FIC Singapore and any party authorised by FIC Singapore an unlimited, irrevocable, worldwide, perpetual, royalty-free right and licence to use any material submitted as part of his/her entry into the Contest in any manner and for any purpose FIC Singapore may see fit, in all forms of media now known or hereafter invented.

 

31.    In addition to being featured on NGC Singapore’s Instagram account, selected entries, including all winning entries, may be featured on FIC Singapore or NGC Singapore’s websites and social media pages, such as but not limited to Facebook.

 

32.    Each entrant acknowledges and agrees that all copyright and trademarks and all other intellectual property rights in the Fox International Channels and National Geographic Channel Asia websites and all material or content contained within it is, and shall remain at all times, the property of Fox International Channels, NGC Network Asia, LLC, its related companies or its licensors. All material and content contained within these websites is made available for the entrant’s personal non-commercial use only and he/she acknowledges and agree that he/she may download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content on these websites is strictly prohibited.

Governing Law and Jurisdiction

33.    This Contest, the Specific Rules and the Terms and Conditions shall be governed in all respects by the laws of Singapore and all disputes will be subject to the exclusive jurisdiction of the courts of Singapore.

 

34.    Each entrant is fully responsible for ensuring that his/her participation in the Contest is lawful in accordance with the laws of the country of which he or she is a citizen and/or resides, and/or happens to be at the time that the contest entry is made. None of FIC Singapore, the Specified Companies, their servants or agents makes any representations, express or implied, as to the lawfulness of the Contest or any entrant's participation in the Contest.

 

35.    Any provision in the Specific Rules and these Terms and Conditions that is prohibited or otherwise unenforceable in any jurisdiction, is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability but does not invalidate the remaining provisions in the Specific Rules and these Terms and Conditions nor affect the validity or enforceability of that provision in any other jurisdiction.
